1. Agreement

These Terms of Use ("Terms") govern your use of thetazeta-dke.com and its members-only alumni portal (together, the "Site"). By visiting the Site, creating a portal account, submitting a form, registering for an event, or making a payment, you agree to these Terms and to our Privacy Policy, Cookie Policy, and Payment & Refund Policy, which are part of these Terms. If you do not agree, please do not use the Site.

2. About the Association and this Site

The Site is operated by the Theta Zeta Alumni Association (the "Association," "we," "us"), the alumni organization of the Theta Zeta Chapter of Delta Kappa Epsilon at the University of California, Berkeley, 2302 Piedmont Avenue, Berkeley, CA 94704, alumni@thetazeta-dke.com. The Association supports the chapter through alumni events, communications, mentorship, and fundraising.

The Association is not the University of California, and the Site is not endorsed by or affiliated with the University. The Association is also distinct from Delta Kappa Epsilon International and from California Alumni of D.K.E., the housing corporation that owns the chapter house at 2302 Piedmont Avenue. Each is a separate organization.

3. Using the Site

You may use the Site for personal, non-commercial purposes connected to the Theta Zeta alumni community. You agree not to:

  • use the Site in any way that violates a law or the rights of others;
  • submit false, misleading, or impersonating information, or register for the portal if you are not a verified brother of Theta Zeta;
  • copy, scrape, harvest, or download member information, photos, or content in bulk, whether by hand or by automated means;
  • interfere with the Site's security or operation, probe for vulnerabilities, or circumvent access controls;
  • upload anything that contains malware or that is unlawful, defamatory, harassing, obscene, or infringing; or
  • use the Site to send unsolicited commercial, political, or fundraising messages to other members.

We may suspend or terminate your access to the Site or the portal at any time if we believe you have violated these Terms or if your membership status changes.

4. Member portal accounts

The alumni portal is for initiated brothers of the Theta Zeta Chapter whose status has been verified by the Association. Access is granted at the Association's discretion and may be revoked at any time. You are responsible for keeping your login credentials confidential and for everything that happens under your account. Do not share your login. Tell us right away at alumni@thetazeta-dke.com if you believe your account has been used without permission. You may close your account at any time by emailing us.

5. Directory and member information

The directory, map, events page, and Mystic Circle inside the portal contain personal information about other brothers. That information is provided in confidence for the sole purpose of helping brothers stay connected. You agree to use it only for personal, non-commercial alumni contact, not to share it outside the brotherhood, not to compile it into lists, and not to use it for solicitation, recruiting, marketing, political activity, or any commercial purpose. Contact requests are routed through the Alumni Board so that each brother decides whether to share his own contact details. Misuse of member information will result in loss of portal access and may violate privacy and anti-spam laws.

6. Your submissions

When you submit content to the Site, including messages, profile details, bios, photos, files, remembrances, and event information ("Submissions"), you keep ownership of it. You grant the Association a non-exclusive, royalty-free, worldwide license to use, reproduce, edit, and display your Submissions in connection with the Association's activities, including the Site, the portal, the alumni newsletter, and chapter history materials. You may ask us to remove a Submission at any time by emailing us, and we will do so unless we are required to keep it.

You represent that you have the right to submit the content, that it is accurate to the best of your knowledge, and that it does not infringe anyone's rights or reveal private information about another person without their consent. We review Mystic Circle remembrances before posting and may edit or decline any Submission.

7. Donations, dues, and event payments

Payments on the Site are processed by Squarespace Payments. By making a payment you agree to the processor's terms and confirm that you are authorized to use the payment method. All payments made through the Site, including donations, dues, and event reservations, are final and non-refundable except as described in our Payment & Refund Policy.

Tax notice. The Theta Zeta Alumni Association is not a 501(c)(3) charity. Contributions, dues, and event payments made to the Association are not tax-deductible as charitable contributions for federal income tax purposes. Consult your tax advisor about your own situation.

Donations support the Association's mission, including chapter support, house improvements, scholarships, and alumni programs. Unless a gift is made to a specific named fund, the Association may apply it where it is most needed.

8. Events

Event details posted on the Site may change. We will make reasonable efforts to notify registrants of changes. Attendance at Association events is voluntary and at your own risk; you are responsible for your own conduct and for complying with the rules of the venue, the University, and the law, including laws about alcohol. The Association may refuse admission to or remove anyone from an event. Any event-specific waiver or release you sign controls over these Terms for that event.

9. Our content and trademarks

Unless otherwise noted, the text, design, photographs, historical materials, and other content on the Site are owned by or licensed to the Association and are protected by copyright and other laws. You may view, download, and print pages for personal, non-commercial use, and you may share links to public pages. Any other use requires our written permission.

"Delta Kappa Epsilon," "DKE," "ΔΚΕ," the DKE crest and lion, and related names and symbols are marks of Delta Kappa Epsilon Fraternity and are used here by the Theta Zeta chapter and its alumni under the chapter's charter. "University of California," "UC Berkeley," and "Cal" are marks of the Regents of the University of California, used only to identify the chapter's location. No license to any of these marks is granted by the Site.

10. Copyright complaints

We respect the intellectual property of others. Much of the Site's historical material comes from chapter archives and alumni contributions, and we make good-faith efforts to identify sources. If you believe content on the Site infringes your copyright, or if you appear in a photo and want it removed, email alumni@thetazeta-dke.com with (1) a description and the URL of the material, (2) your contact information, (3) a statement that you believe in good faith the use is not authorized, and (4) a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act for the owner. We will review and, where appropriate, remove the material promptly.

11. Third-party links and services

The Site links to and embeds services operated by others, such as Google Maps, Mailchimp newsletter archives, and payment pages. Those services have their own terms and privacy policies, and we are not responsible for them.

12. Disclaimers

The Site and its content are provided "as is" and "as available." The Association is run by volunteers, and although we try to keep the Site accurate and available, we make no warranty of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. Historical information, dates, and biographical details are compiled from chapter records and may contain errors; please tell us if you spot one. Nothing on the Site is legal, tax, or financial advice.

13. Limitation of liability

To the fullest extent permitted by law, the Association and its officers, board members, volunteers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or profits, arising out of or related to your use of the Site, even if advised of the possibility of such damages. To the fullest extent permitted by law, the Association's total liability for any claim relating to the Site will not exceed the greater of the amount you paid to the Association through the Site in the twelve months before the claim or one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

14. Indemnity

You agree to defend, indemnify, and hold harmless the Association and its officers, board members, volunteers, and agents from any claims, losses, and expenses (including reasonable attorneys' fees) arising from your Submissions, your misuse of member information, or your violation of these Terms or the law.

15. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. If you have a concern, please email us first; most issues can be resolved informally. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Alameda County, California, and you consent to their jurisdiction, except that either party may bring an eligible claim in small claims court.

16. General terms

We may update these Terms from time to time by posting a new version here with a new "last updated" date; continued use of the Site after that date means you accept the updated Terms. If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the policies they reference, are the entire agreement between you and the Association about the Site. You may not assign your rights under these Terms; we may assign ours to a successor organization.
